1. THE DIGITEC INTERNET SHOPPING CHANNEL
1.1 Welcome to the Digitec Internet shopping channel for the products of Digitec Systems Limited. Making a full range of products of Digitec and complementary products of third parties available to you.
2. ACCEPTANCE OF CONDITIONS OF PURCHASE
2.1 Products from this channel are governed by UK terms and conditions ("Conditions") together with the General User Conditions for digitec.co.uk which you should read carefully before using the Service. By using the Service you indicate your agreement to be bound by the Conditions and the General User Conditions, whether you are a registered user of the Service or not. The Conditions and the General User Conditions represent a binding contract between Digitec Systems Limited and you and the Conditions will be read subject to and fully inclusive of the General User Conditions. If you do not agree with them, do not use the Service.
2.2 Any Digitec software Products purchased will be subject to our standard software licence, details of which accompany the software itself.
2.3 It is the responsibility of the purchaser to ensure that the Digitec Product Range meets their requirements before purchasing.
3. SECURITY
3.1 To purchase items from the Digitec internet shopping channel, we may require you to provide details of your credit or debit card. Digitec cannot be liable for any loss or damage arising from the use of your credit or debit card when purchasing items from Digitec.
4. YOUR REPRESENTATION AND WARRANTY
4.1 You represent and warrant, for the benefit of Digitec, that (a) you are at least 18 years of age; (b) you possess the legal right and ability to enter into this agreement and use your credit or debit card on your own behalf or on behalf of the person for whom you are purchasing the goods and, (c) all information that you submit to us is true, accurate and up to date.
5. ORDER AVAILABILITY, SHIPPING, CANCELLATION AND RETURNS
5.1Provided that you follow this returns procedure in
accordance with its terms, we shall refund to you the price you paid for the
Program (excluding any carriage costs).
5.2In the event that you wish to return your software to us for a refund, please ring us on 0870 606 0580 within the free Digitec Cover period or, if such period does not apply to the software, within 30 days of receipt of your order (which shall be deemed to be 2 days after posting by us) to arrange your return. You will be given the following information:-
Your return package must:-
- include the return number (so that the return can be identified);
- include the software CD with all packaging and associated documentation in
good condition;
and
- be clearly marked with the following address:-
We will either arrange for your package to be collected by courier on the collection date you are given or request you to return the package to us. You will be issued with a collection form which you should keep for your records as confirmation of the return.
In the event that this returns policy differs from that in the software licence agreement accompanying the software, the returns policy in the software licence agreement shall apply in place of the above policy.
6. CUSTOMER SATISFACTION
6.1 Digitec wants all its customers to be completely satisfied with products and services which it buys or receives from Digitec. If you are unhappy with any products purchased from this channel, please call our Sales Department.
7. PAYMENT AND PRICING
7.1 Payment will be by valid credit or debit cards acceptable to Digitec.
7.2 When paying by card, by submitting your order for processing, you authorise us to charge your order, including VAT and delivery charge and amounts described on the site before order submission, to your card. Any refunds in relation to returns or cancellation will be credited to the same card.
7.3 If your card cannot be verified, is invalid or is not otherwise acceptable, your order may be suspended or cancelled automatically.
7.4 Payment of all invoices must be made within 30 days of receipt by you.
7.5 All prices and availability of products are subject to change without notice, and are exclusive of VAT and delivery charges unless otherwise stated.
8. CHANGES TO SHOP CONDITIONS
8.1 This channel is like a shop – every time a customer enters the shop the customer is bound by the rules in effect on the date of the customer’s visit. Similarly, on this channel you are bound by the version of these conditions as in effect on the date of your visit or order.
8.2 The Conditions and the General User Conditions may change from time to time, so please review them each time you make a purchase.
9. TITLE AND RISK
9.1 Title to the products passes from Digitec to the customer on despatch from Digitec or our suppliers warehouse.
9.2 Loss or damage occurred during delivery or shipment is not the responsibility of Digitec.
10. EXCLUSIONS AND LIMITATIONS
10.1 In relation to purchases of software, these will be subject to the exclusions and limitations included in the licence for the relevant software product.
10.2 In relation to all other products, Digitec will not be liable for loss of profits, loss of business or other consequential, special or indirect loss arising out of the use of such product.
10.3 Digitec does not wish to limit or exclude liability for death or personal injury carried by its own negligence.
10.4 All implied warranties and undertakings are hereby excluded to the maximum extent permitted by law.
